Your Rights Under GDPR

  1. Right to be Informed. You have the right to be informed about the collection and use of your personal data. How we help: The privacy policy is designed to inform you about how your information is processed, as well as what your rights are.
  2. Right of Access. You have the right to access your personal data and supplementary information to be aware of and verify the lawfulness of processing. How we help: After signing in, we allow you to access your personal data in JSON format, along with supplementary information in your privacy settings.
  3. Right to Rectification. You have the right to have personal data rectified if it is inaccurate or incomplete. How we help: After signing in, we allow you to edit your personal data via your profile page.
  4. Right to Erasure. You have the right to request the deletion or removal of your personal data where there is no compelling reason for its continued processing. How we help: After signing in, you can request that your account be restricted. Your data will be removed from Talynceand placed in restricted archival storage for 2 years before being deleted to comply with relevant laws governing employment records retention.
  5. Right to Restrict Processing. You have the right to 'block' or suppress processing of your personal data. How we help: After signing in, you can request that your account be restricted. Your data will be removed from Talynceand placed in restricted archival storage for 2 years before deletion.
  6. Right to Data Portability. You have the right to obtain and reuse your personal data for your own purposes across different services. How we help: After signing in, you can export your personal data in JSON format in your privacy settings.
  7. Right to Object. You have the right to object to processing based on legitimate interests, direct marketing, or processing for research and statistics. How we help: You can object by changing your email settings, by exercising your right to restrict processing, or by contacting support@talynce.com.
  8. Automated Individual Decision-Making, including Profiling. You have the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects. How we help: The data we collect is not necessarily used in automatic decision making. If our client uses automated decision making, you may require human intervention. Please contact the Controller who invited you to complete an Assessment.

For our European customers, we want to explain how we handle privacy and the protection of your data at Talynce(TalyncePTE. LTD. incorporated in Singapore with Unique Entity Number UEN 201837827Z – "Talynce.com", "we", "us" or "our") when you visit our website at https://talynce.com/ or use our services.

Your privacy is important to Talynce.com. We strive to protect your privacy at all times and apply the highest ethical and regulatory standards. That is why all communication through our TalynceSoftware-as-a-Service (the "SaaS") is encrypted using state-of-the-art SSL encryption. This Privacy Policy explains how we collect, use, disclose, transfer, and store your information – including personally identifiable information ("Personal Data") – and provides information about our use of cookies, analytics tools, and marketing practices.

Other than as expressly set out in this Privacy Policy or as otherwise required or permitted by law, we will not share, sell, or distribute any of the information you provide without your consent.

WE COLLECT, USE, TRANSFER OR FORWARD PERSONAL DATA IN COMPLIANCE WITH THE PRIVACY PROTECTION LAWS OF THE FEDERAL REPUBLIC OF GERMANY AS WELL AS WITH THE PRIVACY REGULATIONS OF THE EUROPEAN UNION.

I. Who is Responsible for Data Processing?

As part of our provision of the TalynceSaaS to you and from our interactions with you, Talynceneeds to collect Personal Data either as controller or as processor on behalf of an employer.

If you visit our website at https://interviewer.ai/, we process personal data as controller. Please ask us if you would like information about the Personal Data we store. II. Which Data Are Processed and What Are Their Sources?

We process personal data (Art. 4 Nr. 1 GDPR) received during our business as a SaaS provider for AI video recruiting. Our service is used by Attendees ("you") to provide additional information for employers during a job application process. Typically, we work on behalf of an employer who is our customer. In such cases, please also refer to the employer's privacy policy. However, if you visit our website, we process personal data as the data controller.

III. Purpose and Legal Basis for Processing

We process personal data to provide our services and to respond to your requests. Our processing is based on:

  • Consent (Art. 6(1)(a) GDPR): To communicate with you and advertise our services.
  • Contractual Obligations (Art. 6(1)(b) GDPR): For the provision of our services once a contractual relationship is established.
  • Legal Requirements (Art. 6(1)(c) GDPR): For obligations such as tax compliance.
  • Vital Interests (Art. 6(1)(d) GDPR): In exceptional cases, to protect the vital interests of a data subject or another person.
  • Legitimate Interests (Art. 6(1)(f) GDPR): For processing necessary for our or a third party's legitimate interests, provided such interests are not overridden by your rights.

IV. Server Logfiles

We collect and store information in server logfiles based on Art. 6(1)(f) GDPR. This includes data automatically sent by your browser (e.g., shortened IP-address, browser type, operating system, referrer URL, date and time, transmitted data amount, and your ISP). This data is used solely for statistical purposes and is not linked with other data.

V. Use of Cookies

Our website uses cookies based on Art. 6(1)(f) GDPR for technically necessary cookies and on Art. 6(1)(a) GDPR for others. A cookie is a text file stored on your device that holds information. Cookies help tailor advertising and provide usage statistics. You can manage cookie settings in your browser, but some website functionality may be limited if cookies are disabled.

VI. Period of Data Storage

We store your personal data only for as long as necessary to fulfill the purposes for which it was collected or as required by law. Once the purpose has expired and legal retention requirements are met, data is routinely erased or its processing is restricted.

VII. Transfer of Personal Data to Third Countries

We use various cloud services, including US-based providers and providers from outside the EU/EEA or Singapore, to process personal data on our behalf. Data is transferred under the Privacy Shield Agreement and/or via standard contractual clauses.

VIII. Automated Decision-Making

We do not use automated decision-making processes under Art. 22 GDPR that produce legal or similarly significant effects. If an employer uses our SaaS for automated decision making, you may request human intervention by contacting the relevant Controller.

IX. Documentation of Declared Consents

If you have consented under Art. 9 GDPR to anonymize your personal data, you have agreed that Talyncemay anonymize your data to process it in an anonymized form. You may withdraw your consent at any time.

X. Additional Information Regarding Video-Recruiting

The purpose of data processing in Video-Recruiting is to provide an objective personality profile by analyzing video and audio recordings using AI. By participating in a Video Interview, which may be recorded and stored, you consent to the processing of your facial expressions, voice patterns, and speech for analysis.

XI. Your TalynceAccount

In order to use our SaaS, you must create an account. We collect information such as your email address, personal name, company details, and other necessary contact information. This data is used to manage your account and access our services.

Additional device-related information, log data, and location data are also collected for security, troubleshooting, and personalized service purposes.

XII. Third Party Technology

We may offer login options via Google or LinkedIn. Additionally, our website logs basic information (e.g., domain name, IP address, browser type) for access statistics. Certain support or service requests may require additional Personal Data.

XIII. Rights of Data Subjects

Under Art. 15-21 GDPR, you have the right to:

  • Request access to your personal data.
  • Rectify inaccurate or incomplete data.
  • Request deletion or restriction of processing of your data.
  • Obtain your personal data in a portable format.
  • Object to processing based on certain legal grounds.

If you believe that our processing of your personal data infringes the GDPR, you have the right to lodge a complaint with a supervisory authority.

1. Binding Agreement

1.1 TalyncePte. Ltd. (Singapore UEN 201837827Z) ("Talynce.com", "we", "us", "our") provides a platform for interactions between employers and candidates. Your access and use of the Platform constitutes your consent to this Agreement.
1.2 We may update these terms from time to time. Continued use of the Platform constitutes acceptance of the new terms.

2. Definitions

Terms such as "Candidate", "Employer", "Candidate Profile", "User Content", "Personal Data", and "Platform" are defined in this Agreement.

3. Registration

You must be at least 18 years old to register an account. All information provided must be accurate and up-to-date. We reserve the right to delete inactive accounts.

4. Password and Security

You are responsible for maintaining the confidentiality of your login details. If you suspect any compromise of your account, please notify us immediately.

5. Use of Platform

You are granted a non-transferable, personal right to use the Platform for employment-related purposes. Misuse of the Platform or violation of these terms may result in suspension or termination of your account.

6. Availability of Services

We strive to maintain continuous availability of the Platform; however, we cannot guarantee uninterrupted or error-free service.

7. Intellectual Property

All intellectual property rights in the Platform are owned by Talynce.com, subject to your rights under this Agreement.

8. User Content

You retain ownership of any User Content you provide, but grant Talyncea license to use it in accordance with this Agreement.

9. Personal Data

We collect, use, and disclose Personal Data as described in this Privacy Policy and in accordance with applicable laws. Please review Sections 9.1 to 9.7 for details on data collection, purpose, retention, security, and transfer.

10. Third Party Websites

Our Platform may contain links to third-party websites. We are not responsible for the content or privacy practices of these external sites.

11. Term and Termination

These terms remain in force while you use the Platform. We reserve the right to terminate your access if you breach these terms.

12. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our aggregate liability shall be limited to S$[100].

13. Disclaimer

Talynceis solely a platform provider and does not participate in employment decisions. We are not liable for any employment decisions or losses arising from your use of the Platform.

14. Indemnity

You agree to indemnify and hold harmless Talynceand its affiliates from any claims arising out of your use of the Platform or breach of these terms.

15. Applicable Law

This Agreement shall be governed by the laws of Singapore.

16. Dispute Resolution

Any disputes arising from this Agreement shall be resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with its rules. The seat of arbitration shall be Singapore, the language English, and you agree to attempt mediation at the Singapore International Mediation Centre (SIMC) in good faith before arbitration.

17. Miscellaneous

These terms constitute the entire agreement between you and Talynce.com. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect. If you have any questions, please contact us at support@talynce.com.
